日前，美國聯(lián)邦海事委員會（FMC）出臺了一項新規(guī)，明確提到，一旦FMC發(fā)現(xiàn)承運(yùn)人向托運(yùn)人收取的費(fèi)用“不合理”，或有其他可能違反美國《海運(yùn)改革法案》（the Ocean Shipping Reform Act of 2022）的行為，FMC會立即下令，讓承運(yùn)人退還費(fèi)用。新規(guī)將于今年4月生效。

具體而言，對于“不合理”收費(fèi)，FMC解釋稱，一旦發(fā)現(xiàn)承運(yùn)人提供給托運(yùn)人的發(fā)票中包含“不準(zhǔn)確的信息”，或提供的發(fā)票信息內(nèi)容未能滿足FMC的規(guī)定，承運(yùn)人將要向托運(yùn)人支付退款。退款金額將考慮承運(yùn)人“不合理行為”的性質(zhì)、情節(jié)和嚴(yán)重程度。

對于違反美國《海運(yùn)改革法案》的相關(guān)行為，FMC將勒令承運(yùn)人退還托運(yùn)人已支付的費(fèi)用。

FMC強(qiáng)調(diào)，發(fā)票內(nèi)容至少需要體現(xiàn)如下信息：

——集裝箱可用日期（Date that container is made available）

——卸貨港（Port of discharge）

——集裝箱號碼（Container number）

——出口集裝箱最早返箱日期（Earliest return date for export containers）

——免箱期（Number of allowed free-time days for holding containers）

——免箱期起止時間（Free time start and end dates）

——基于運(yùn)費(fèi)標(biāo)準(zhǔn)的滯期費(fèi)規(guī)則（Applicable detention or demurrage rule on which the daily rate is based）

——應(yīng)付總額（Total amount due）

——有關(guān)問題或費(fèi)用減免請求的聯(lián)系信息（Contact information for questions or requests for mitigation of fees）

——聲明符合FMC關(guān)于滯期費(fèi)和滯箱費(fèi)的相關(guān)規(guī)定（statement that the charges are consistent with any of FMC rules with respect to detention and demurrage）

——聲明公共承運(yùn)人的履約行為，沒有導(dǎo)致或產(chǎn)生相關(guān)發(fā)票費(fèi)（statement that the common carrier’s performance did not cause or contribute to the underlying invoiced charges）
